General and Definitions
The ZIGAROFFICIAL.COM website (hereinafter: "the Website") is operated by [Company/Partnership Name], Company No./Dealer No. [Number] (hereinafter: "the Company" or "the Website Management").
Use of the Website, including browsing, accessing information, and purchasing products through the Website, constitutes your unconditional agreement to the terms detailed in this regulations document (hereinafter: "the Terms"). These Terms constitute a legally binding agreement between you (hereinafter: "the User" or "the Customer") and the Company. If you do not agree to any of these Terms, you are strictly requested to immediately cease any use of the Website.
The Website Management reserves the sole and absolute right to update, amend, or modify these Terms from time to time, at its sole discretion and without prior notice. The binding version of the Terms shall be the version published on the Website at the time the respective action or transaction is performed.
Age Restriction and Legal Capacity
Eligibility to Purchase: Pursuant to the Israeli Restrictions on Advertising and Marketing of Tobacco and Smoking Products Law, 5743-1983, purchasing on the Website is strictly permitted only to users aged 18 and older who possess full legal capacity and hold a valid payment method (credit card or approved clearing account) issued in their name.
By executing a purchase on the Website, the User conclusively declares, warrants, and confirms that they are over 18 years of age. The Company and/or anyone on its behalf (including the courier company) reserve the right to require the Customer to present official government-issued identification (ID card/driver’s license/passport) upon delivery. If it is discovered that the Customer is a minor, the transaction shall be canceled immediately without any liability or claim against the Company.
Products, Inventory, and Pricing Policy
Product Originality: All products displayed on the Website (including jet lighters, cutters, ashtrays, and complementary accessories) are brand new, original products supplied in their original packaging.
Illustrative Images: Product images and videos displayed on the Website are for illustration purposes only. Slight variations in shades, textures, or design may occur between the image on screen and the actual physical product due to display resolutions, and such variations shall not constitute a "non-conformance" claim.
Prices and Taxes: Product prices displayed on the Website include Value Added Tax (VAT) as required under Israeli law, unless stated otherwise, and exclude shipping fees, which will be added during the checkout process.
Typographical/Clerical Errors (Section 14 of the Israeli Contracts Law): In the event that an extraordinary error is made in good faith regarding the price or description of a product (clerical error), the Company shall not be bound by the transaction. The Website Management shall be entitled to cancel the transaction and issue a full refund, and the Customer shall have no right to enforcement or compensation.
Out of Stock: The Company makes every effort to ensure inventory is updated in real-time. If an ordered product is out of stock, the Company will notify the Customer as soon as possible. The Customer will be given the option to choose an alternative equivalent product or cancel the transaction with a full and immediate refund, with no cancellation fees. The Customer shall have no further claims against the Company regarding inventory deficiencies.
Transaction Cancellation and Product Return Policy
he cancellation policy operates in strict compliance with the provisions of the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Transaction Cancellation), 5771-2010:
Standard Cancellation Period: A consumer is entitled to cancel a distance-selling transaction and receive a refund within 14 days from the date of physical receipt of the product, or from the date of receiving the transaction disclosure document, whichever is later.
Extended Cancellation Period for Protected Populations (Section 14C1 of the Law): A Customer who is a person with disabilities, a senior citizen (over the age of 65), or a new immigrant (Oleh Hadash) is entitled to cancel the transaction within four (4) months from the date of receiving the product or the disclosure document, whichever is later, provided that the transaction involved a communication (including electronic text communication such as chat/WhatsApp/email) between the dealer and the consumer. The Company may request official documentation verifying the Customer's status.
Physical Return Conditions: Cancellation and refunds will be granted only if the product is returned closed, in its original, unopened, and undamaged packaging, complete, free of defects, and completely unused. It is explicitly clarified that opening gas mechanisms, filling lighters with gas, igniting them, or using cutters and ashtrays completely revokes the right of cancellation under the law, as such actions are deemed a material modification and use.
Cancellation Fees: Upon cancellation of a transaction not due to a defect or non-conformance, a legal cancellation fee shall be deducted at a rate of 5% of the transaction amount or 100 ₪, whichever is lower. The cost and responsibility of shipping the product back to the Company's warehouse shall be borne entirely by the Customer.
Defective Products or Non-Conformance: The Customer must inspect the product immediately upon receipt. In the event of a defect or non-conformance, the Customer must notify the Company’s customer service without delay and immediately upon discovery. The Company will arrange to collect the defective product and provide a functional replacement or a full credit (at the Customer's discretion), without any cancellation fees or additional shipping costs.
Methods for Submitting a Cancellation Notice: The Customer may submit a cancellation notice via one of the following methods: Phone: [Phone Number], Email: [Email Address], or via the dedicated transaction cancellation link located on the Website’s homepage. The notice must specify the Customer's full name, order number, and ID number.
Limitation of Liability and Safety (Defective Products Liability Law)
The User acknowledges that certain products sold on the Website (specifically jet lighters and combustion accessories) involve flammable gas and high-temperature flames, which present inherent risks if handled improperly.
The Company, its directors, employees, or representatives shall not be held liable for any bodily injury, property damage, direct, indirect, consequential, special, or punitive damages incurred by the User, gift recipient, or any third party resulting from improper, negligent, or unreasonable use, incorrect gas refilling, exposure to extreme heat, or use contrary to the safety and manufacturer guidelines attached to the products or published on the Website. In any event and under any legal theory, the Company's liability shall be capped at the actual amount paid by the Customer for that specific product.
Intellectual Property
All intellectual property rights on the Website, including but not limited to: website design, source code, graphical structure, trademarks, the Zigar Official logo, copyright in texts, maintenance guides, images, audio, and videos, belong exclusively to the Company (or third parties who licensed them to the Company).
It is strictly prohibited to copy, reproduce, distribute, sell, translate, reverse engineer, or make any commercial or unauthorized use of the Website content without the prior written consent of the Company.
Governing Law and Jurisdiction
These Terms, their interpretation, validity, and any legal dispute arising therefrom or from the use of the Website shall be governed solely by the laws of the State of Israel.
Exclusive jurisdiction for any matter or legal dispute arising between the User and the Company shall be granted solely to the competent courts in the District of [Tel Aviv / Central], and the parties explicitly waive the local jurisdiction of courts in any other district.
